How To Obtain Power of Attorney

Q.  What do I need to do to gain power of attorney over my aunt?

A.  If your aunt would like you to act as her agent under a power of attorney, she can have her attorney prepare a power of attorney for her signature. The document should be prepared by an attorney in the jurisdiction where your aunt resides. If she has residences or real property in more than one state, it would be a good idea to obtain a power of attorney for each separate state, so that if your aunt later becomes incapacitated, it would be easier to handle her affairs. You may want to suggest to her that she discuss with her trust attorneywhether a revocable trust would also be appropriate for her.
