How Can I See My Mother If My Brother Prevents Me From Visting?

Q.  My brother has power of attorney for my mother's medical health and now he wants guardianship of her. She cannot take care of herself. My brother blocked me from seeing my mother and getting into her house. He is not letting me know what is going on with her. What should I do?

A.  If your brother is preventing you from visiting your mother, you may want to consider commencing a guardianship proceeding seeking court approval either for you to be appointed your mother's guardian, or to have an independent third party appointed to handle her affairs. You should consult with a competent elder law attorney in the jurisdiction where your mother resides.
