Denial of Access To Patient In Nursing Home

Q.  Can my cousin, who is my mother's agent under a power of attorney, deny me the right to call my mother and talk to her by phone and/or visit her in person at the nursing home?

A.  A power of attorney gives the agent the right to handle the principal's financial affairs. If your cousin is abusing the power of attorney form and attempting to deny you the right to visit and communicate with your mother, and if your mother does not have the capacity to rectify the situation, you may want to consider speaking with the administration of the nursing home to obtain access, and if that is not successful, then retaining the services of a competent elder law attorney to commence a guardianship proceeding seeking the court's intervention.
